Terms of Service
By accessing, loading, or viewing any part of 999cy.press (the "Site"), you ("User") agree to these Terms. If you do not agree, close the tab. Your use of the Site is subject to these Terms and to any separate license agreement you have signed with Invergence LLC ("Invergence").
1 · Ownership
The Site — every HTML file, every WebGL shader program, every color palette, every motion parameter, every layout, the compiled JavaScript, and the live rendered visual output — is the proprietary work of Invergence LLC, protected under the U.S. Copyright Act, the Digital Millennium Copyright Act, the Defend Trade Secrets Act, and equivalent foreign statutes.
⛤ Shader notice ⛤
The three real-time shader programs rendered in the Trilogy poster — internally the Loft, Blueprint, and Fold effects — are ports of shaders from the Invergence live-projection suite. Their source form is confidential, their algorithms are trade secrets, and their rendered output is published only for personal, in-browser viewing of this Site.
No portion of any shader — not the GLSL source, not the compiled bytecode, not a screen-capture of its output, not a reverse-engineered reconstruction — may be used for any purpose other than viewing this Site in a standard web browser, without a separate written license signed by an authorized officer of Invergence LLC.
2 · Permitted use
Subject to these Terms, Invergence grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site in a standard consumer web browser for your own personal, non-commercial enjoyment. Nothing else is granted — expressly or by implication.
3 · Prohibited use
You may NOT, and you may not permit any other person or automated system to, do any of the following without a separate prior written agreement signed by an authorized officer of Invergence LLC:
(a) Commercial reuse
Use the Site, any shader, any rendered frame thereof, or any other component of the Site in or in connection with any commercial product, service, event, performance, broadcast, stream, installation, exhibition, advertisement, non-fungible token, or other revenue-generating or promotional activity.
(b) Reproduction and redistribution
Copy, download, mirror, scrape, archive (beyond ordinary browser cache), rehost, republish, sublicense, sell, rent, lease, lend, or otherwise distribute the Site or any portion thereof.
(c) Derivative works
Modify, adapt, translate, port, fork, or prepare derivative works of any shader, animation, palette, layout, or other Site component, or combine any such component with other software or content to produce a new work.
(d) Reverse engineering
Reverse engineer, decompile, disassemble, deobfuscate, extract, capture from GPU memory or framebuffer, or otherwise attempt to reconstruct the source form, parameters, internal states, uniform values, or underlying algorithms of any shader, except to the minimum extent such activity is expressly permitted by applicable law notwithstanding this limitation.
(e) Machine-learning use
Use any component of the Site — including rendered frames, screenshots, video recordings, or extracted source — as training data, fine-tuning data, evaluation data, conditioning input, style reference, or any other input to any machine-learning model, generative AI system, neural network, or automated creative-output system. This prohibition applies whether the resulting model is commercial, academic, or personal, and is binding whether or not this Site is scraped in defiance of robots.txt or similar signals.
(f) Capture and re-use of rendered output
Record, screenshot, screen-capture, film, live-stream, or otherwise fix in a tangible medium the visual output produced by the Site's shaders for the purpose of reproduction, redistribution, public performance, public display, or any use described in (a)–(e) above. Incidental personal screenshots for private, non-commercial enjoyment are permitted.
(g) Circumvention
Circumvent, disable, or interfere with any content-protection, rate-limiting, authentication, watermarking, telemetry, or security mechanism of the Site.
(h) Automated access
Access the Site by means of any bot, spider, crawler, scraper, headless browser, or other automated system, except that well-behaved search-engine indexers obeying the Site's robots.txt are permitted to index public HTML metadata.
(i) Attribution removal
Remove, obscure, alter, or falsify any copyright, trademark, credit, watermark, or other proprietary notice contained in or displayed by the Site.
(j) Misrepresentation
Hold yourself out as the author of, or as licensed to distribute, any shader or other Site component.
4 · Trade-secret status of the shaders
You acknowledge that the following elements constitute trade secrets of Invergence LLC under the U.S. Defend Trade Secrets Act (18 U.S.C. § 1836 et seq.) and comparable state and foreign laws:
- the GLSL source of every shader served by this Site;
- the specific parameter curves, iteration counts, and color-trap equations used inside those shaders;
- the audio-reactivity mappings and sensor-to-uniform routing;
- the inclinometer- and motion-driven camera behaviors;
- the palette-shift algorithms;
- and the per-plugin pad vocabularies incorporated or referenced by these shaders.
You agree not to disclose, publish, or exploit any such trade secret that may come to your attention through use of the Site. Incidental knowledge gained from permitted viewing confers no license.
5 · Tickets & payments
Ticket purchases are processed by Stripe, Inc. and are subject to Stripe's own terms in addition to these. Tickets are non-refundable except as required by applicable consumer law or explicitly stated by Invergence in a separate written communication. Prices are final at checkout and locked in USD. Each ticket admits one person to the Trilogy event on the date and at the venue listed on the Site, subject to the venue's own entry policies, age restrictions, and capacity constraints.
6 · RSVP / essay submissions
If you submit a 147-word essay under the PIN-holder RSVP mechanism, you grant Invergence a non-exclusive, royalty-free, worldwide license to display your submission, in whole or excerpt, on the Site and in event materials, with credit to the initials you provide. You retain ownership of your original words. Do not submit anything you are not willing to have displayed publicly.
7 · Enforcement and remedies
Unauthorized use of the Site — particularly reverse engineering, extraction, or ML-training use of the shaders — will cause irreparable harm to Invergence for which monetary damages would be inadequate. You consent to entry of injunctive and other equitable relief, without bond and without any requirement to exhaust other remedies, in addition to any damages, costs, and attorneys' fees to which Invergence may be entitled at law.
Invergence expressly reserves all rights under the U.S. Copyright Act (17 U.S.C. § 101 et seq.), the Digital Millennium Copyright Act (17 U.S.C. § 1201 et seq.), the Defend Trade Secrets Act, the Computer Fraud and Abuse Act (18 U.S.C. § 1030), and all comparable statutes.
8 · No warranty
THE SITE AND THE SHADERS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR THAT USE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. THE VISUAL EFFECTS INCLUDE RAPIDLY CHANGING IMAGERY AND MAY NOT BE SUITABLE FOR INDIVIDUALS WITH PHOTOSENSITIVE EPILEPSY. YOU ASSUME ALL RISK OF USE.
9 · Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, INVERGENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR ACCESS TO OR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. INVERGENCE'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
10 · Termination
Your license under Section 2 terminates automatically, without notice, upon any breach of these Terms. Invergence may additionally block, rate-limit, or refuse access to the Site at its sole discretion. Sections 1, 3, 4, 5, 7, 8, 9, 11, 12, and 13 survive termination.
11 · Changes
Invergence may update these Terms at any time by posting a revised version on the Site with an updated effective date. Continued use of the Site after the effective date of a revision constitutes acceptance of the revised Terms.
12 · Governing law and venue
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. Any dispute arising from or relating to these Terms, the Site, or a ticket purchase shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
13 · Severability; entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and the unenforceable provision shall be reformed to the minimum extent necessary to be enforceable. These Terms, together with any written license agreement separately executed between you and Invergence, constitute the entire agreement between the parties regarding the subject matter and supersede all prior or contemporaneous understandings.
